Reflete-se em particular sobre: se a nota discriminativa e justificativa não for remetida no prazo de 10 dias a que se refere ao artigo 25º, n.º 1 do RCP implicará ou não a caducidade do respetivo direito; a obrigatoriedade do depósito da totalidade na nota discriminativa e justificativa das custas de parte aquando da reclamação; e por fim, a ratio subjacente ao artigo 26º-A n.º 2 do RCP e a sua (in)constitucionalidade.ABSTRACT: We will address some questions about the discriminatory note and justification of part costs, starting from the analysis of the applicable legislation and the relevant doctrine and jurisprudence.
