| dc.description.abstract | O presente texto tem o intuito de salientar algumas incongruências consagradas no atual ordenamento jurídico relativas à ilicitude do despedimento. Por um lado, sustentamos que o prazo de aviso prévio (no despedimento com base em causa objetiva) deve ser tido em conta para a definição do momento da cessação de contrato de trabalho quando o despedimento é ilícito, impedindo que o trabalhador veja os prazos para oposição ao despedimento por extinção do posto de trabalho e por inadaptação, de impugnação do despedimento coletivo e de reclamação de créditos claramente reduzidos e limitados aos estabelecidos na lei para o efeito. Por outro lado, alude-se ao plano quase residual da presunção de despedimento sem justa causa e alerta-se para a problemática do despedimento verbal. | por |
| dc.description.abstract | ABSTRACT: This paper aims to highlight some inconsistencies in the current law related to the unlawful dismissal. On the one hand, we sustain that the period of notice (dismissal based on objective cause) must be taken into account to define the time of the termination of employment contracts when the dismissal is unlawful, so that the worker see the deadlines for opposition to the dismissal clearly reduced comparing to those established by law for that purpose. On the other hand, we emphasize the residual level of the presumption of being unjustly thrown out of work and the problem of verbal dismissal. | eng |
