| dc.description.abstract | Com a entrada em vigor do DL 84/2021, de 18 de outubro, que passou a regular os direitos do consumidor na compra e venda de bens, conteúdos e serviços digitais que, por sua vez, revogou o DL 67/2003, de 8 de abril respeitante à venda de bens de consumo, o conceito de consumidor para efeitos de aplicação do regime é restringido. Passa, pois, e tão-somente, a regular relações entre consumidores em sentido restrito (pessoas singulares) e profissionais, excluindo-se, por sua vez, as pessoas coletivas que, em determinadas circuns-tâncias, podiam assumir a posição de consumidor. Se é certo que até à entrada em vigor do diploma referido os ecos legislativos respeitantes a uma noção ampla de consumidor (enquanto pessoas coletivas) ainda se podiam escutar, também é certo que atualmente se tornaram praticamente inaudíveis. Portanto, é residual, no nosso ordenamento jurídico, a consagração da noção ampla de consumidor, uma vez que tal noção se encontra na LDC, e que é derrogada pela maior parte dos regimes especiais, e numa tímida remissão para tal noção da LDC do artigo 3º, al. b) do DL 134/2009, de 2 de junho. | dc.description.abstract | ABSTRACT: With the entry into force of DL 84/2021, of October the 18th, which began to regu-late consumer rights in the purchase and sale of digital goods, content and services, which, in turn, revoked DL 67/2003, of April the 8th regarding the sale of consumer goods, the concept of consumer for the purposes of applying the regime is restricted. Therefore, it only regulates relationships between consumers in a restricted sense (individuals) and profes-sionals, excluding, in turn, legal persons that, in certain circumstances, could assume the position of consumer. If it is true that, until the entry into force of the aforementioned di-ploma, the legislative echoes concerning a broad notion of the consumer (as legal persons) could still be heard, it is also true that currently they have become practically inaudible. Therefore, in our legal system, the consecration of the broad notion of consumer is residual, since such a notion is found in the LDC, and which is derogated by most special regimes, and in a timid reference to such a notion of the LDC of article 3, al. b) of DL 134/2009, of June the 2nd.
