| dc.description.abstract | No presente estudo dedicamo-nos a uma análise da Lei dos Serviços Públicos Essenciais – Lei n.º 23/96, de 26 de julho - atribuindo um especial enfoque aos mecanismos de tutela do utente de tais serviços. Se é certo que, por um lado, não tem sido doutrinariamente pacífica a qualificação dos contratos de prestação de serviços públicos essenciais enquanto negócios jurídicos de Direito Público ou Privado, por outro, e consequentemente, também não é isenta de discussão a questão sobre onde interpor ação judicial emergente de litígios que oponham o prestador e o utente. Tentaremos, portanto, dar uma resposta a tal questão. Feita uma análise generalista dos referidos mecanismos de tutela do utente centramo-nos, em particular, nas questões relativas à suspensão do serviço por falta de pagamento, estabelecendo um paralelo entre os regimes da Lei dos Serviços Públicos Essenciais e da Lei das Comunicações Eletrónicas. Por fim, abordaremos a questão dos prazos de prescrição e caducidade relativos ao direito ao recebimento do preço do serviço prestado. Neste ponto, em concreto, procuraremos dar uma resposta adequada relativa a que prazo de prescrição recorrer sempre que o serviço seja prestado por uma autarquia local (8 anos ou 6 meses). | pt_PT |
| dc.description.abstract | In the present study we dedicate ourselves to make an analysis of the Law of Essential Public Services, giving a special focus to the mechanisms of protection of the user of such services. If it is true that, on the one hand, it has not been doctrinally peaceful to qualify contracts for the provision of essential public services as public or private law agreements, on the other, and consequently, the question of where to bring legal action arising from disputes that oppose the provider and the user, therefore, we will try to answer that question. Having made a general analysis of the user protection mechanisms, we focus on issues related to the suspension of the service for non-payment, establishing a parallel between the regimes of the Essential Public Services Law and the Electronic Communications Law. Finally, we will address the issue of prescription and lapse periods related to the right to receive the price of the service provided. At this point we will try to give an adequate answer regarding which prescription period to resort whenever the service is provided by a local authority (8 years or 6 months). | pt_PT |
