| dc.description.abstract | O presente artigo tem o objetivo de apresentar os critérios de densificação do princípio da dignidade humana em casos de conflitos de direitos. O problema é formulado através do discurso normativo, regulador do princípio da dignidade humana, e o discurso de aplicação prática, resultante das decisões judiciais de tribunais superiores, incluindo o Tribunal Constitucional. A metodologia de análise é qualitativa e usa a revisão de literatura e jurisprudência, como ponto de partida, para a conceção teórica da dignidade humana esclarecendo o modo como a sua interpretação lata, abraça direitos fundamentais dos cidadãos e cidadãs. A partir desta concetualização, lança-se o olhar sobre decisões judiciais refletindo sobre os critérios de argumentação que desenham o conteúdo prescritivo da dignidade humana. As situações analisadas referem-se a casos de violência doméstica onde é possível identificar cenários de conflitos de direitos entre os sujeitos, designadamente, os que dizem respeito ao confronto derivado de direitos da vítima com os direitos do agressor. Para a presente investigação interessou a compreensão das categorias de enunciados justificativos da decisão judicial, pondo-se em evidência aspetos formais e materiais decorrentes da aplicação dos textos normativos. Reclamase que a interpretação normativa, através do método jurídico dedutivo e indutivo do processo decisório, potencia a delimitação de um conteúdo prescritivo da dignidade humana, no âmbito de direitos conflituantes, que, por sua vez, fixam dinâmicas diferentes entre princípios e normas jurídicas. | por |
| dc.description.abstract | ABSTRACT: The aim of this article is to present the criteria for densifying the principle of human dignity in cases of conflicts of rights. The problem is formulated through the normative discourse, regulating the principle of human dignity, and the discourse of practical application, resulting from the judicial decisions of higher courts, including the Constitutional Court. The analysis methodology is qualitative and uses a review of the literature and case law as a starting point for the theoretical conceptualization of human dignity, clarifying how its broad interpretation embraces the fundamental rights of citizens. Based on this conceptualization, we look at judicial decisions, reflecting on the argumentative criteria that shape the prescriptive content of human dignity. The situations analyzed refer to cases of domestic violence where it is possible to identify scenarios of conflicts of rights between the subjects, specifically those that concern the confrontation between the rights of the victim and the rights of the aggressor. For this research, it was important to understand the categories of statements justifying the judicial decision, highlighting formal and material aspects arising from the application of normative texts. It is claimed that normative interpretation, through the deductive and inductive legal method of decision-making, enables the delimitation of the prescriptive content of human dignity within the framework of conflicting rights, which in turn set different dynamics between legal principles and norms. | eng |
