A reprodução humana assistida: repercussão nos institutos da filiação e sucessão

| dc.description.abstract | O presente artigo visa analisar, com o crescente avanço da ciência, possíveis efeitos jurídicos decorrentes da utilização de técnicas de reprodução humana assistida nos institutos da filiação e sucessão, bem como ressaltar a necessidade de uma legislação brasileira que passe a disciplinar o uso dessas técnicas. Essa temática sobre o uso das técnicas de reprodução humana no Brasil possibilitou a elaboração de um problema especifico envolvendo os institutos da filiação e sucessão, ou seja, saber se o uso das técnicas de reprodução humana assistida estão flexibilizando conceitos jurídicos já consagrados nos institutos da filiação e sucessão. Na busca de uma resposta ao problema levantado, partiu-se de uma hipótese positiva para investigar as possíveis inserções do uso da técnica em conceitos já consagrados dos institutos, filiação e sucessão. Nesse intuito, após uma breve síntese sobre a ciência e a dignidade do ser humano na fase embrionária, são abordadas as técnicas de reprodução humana assistida, e alguns efeitos jurídicos decorrentes da utilização das técnicas de reprodução humana assistida nos institutos da filiação e sucessão que contempla a legislação brasileira. Para a obtenção dos resultados almejados na pesquisa, o método de abordagem a ser seguido será o empírico-dialético, utilizando-se das pesquisas bibliográfica e legislativa, tendo por base os estudos de PEDRO FEMENÍA LÓPEZ, "Status" jurídico civil del embrión humano, con especial consideración al concebido "in vitro" e diversos doutrinadores brasileiros que abordam a temática. Como conclusão, aponta-se para a necessidade de uma legislação brasileira que contemple a reprodução humana assistida com preservação do direito à dignidade, à filiação, à sucessão dos concebidos e dos nascidos da utilização das técnicas. | por |
| dc.description.abstract | ABSTRACT: This article aims to analyse, with the growing advancement of science, possible legal effects arising from the use of human reproduction techniquesassisted in the Institutes of Affiliation and succession, as well as highlight the need for legislation To discipline the use of these techniques. This thematic on the use of human reproduction techniques in Brazil enabled the elaboration of a specific problem involving the institutes of Affiliation and succession, that is, whether the use of assisted human reproduction techniques are easing Legal concepts already established in the Institutes of Affiliation and succession. In the search for an answer to the problem raised, it was a positive hypothesis to investigate the possible inserts of the use of the technique in already established concepts of the institutes, affiliation and succession. In this respect, after a brief synthesis on the science and dignity of the human being in the embryonic phase, the techniques of assisted Huma reproduction are addressed, and some legal effects arising from the use of human reproduction techniques assisted in Institutes of affiliation and succession that contemplates Brazilian legislation. In order to obtain the results sought in the research, the method of approach to be followed will be the empirical-dialectical, using the bibliographical and legislative research, based on the studies of PEDRO FEMENÍA LÓPEZ, "Status" civil legal del Embrión Human, Con special Consideración al designed "in vitro" and several Brazilian doctrines that address the thematic.
