| dc.description.abstract | Como desvio ao princípio da autonomia privada, fruto das vicissitudes da contratação em massa, podemos identificar um modelo formativo de contratos de consumo que se afasta do tradicional e que, por sua vez, se traduz na adesão a cláusulas pré-elaboradas que contemplam de forma genérica e massificada os interesses económicos do proponente e, cujo conteúdo, é, por este, determinado unilateralmente, não assistindo ao potencial aderente a possibilidade de negociação, limitando-se a aceitá-las ou rejeitá-las. Desta forma, com o intuito de prevenir abusos resultantes de contratos pré-elaborados, nomeadamente dos quais constem cláusulas de fidelização, e de promover a igualdade material dos contraentes, estabelece-se, por um lado, a obrigação de redação clara e precisa, em caracteres facilmente legíveis das cláusulas contratuais gerais e, por outro, a proibição de inclusão de tais cláusulas em contratos singulares que originem significativo desequilíbrio em detrimento do consumidor. A sua utilização rege-se pelo DL 446/85 de 25 de outubro que estabelece regras relativas à inclusão em contratos singulares, à interpretação e integração e à fiscalização do seu conteúdo, e que analisaremos no presente artigo. | por |
| dc.description.abstract | ABSTRACT: As a departure from the principle of private autonomy, as a result of the vicissitudes of mass contracting, we can identify a formative model of consumer contracts that departs from the traditional one and which, in turn, translates into adherence to pre-elaborated clauses that contemplate the economic interests of the tenderer, and the content of which is unilaterally determined by the tenderer and does not accept the possibility of negotiation. Thus, in order to prevent abuses resulting from pre-made contracts, including loyalty clauses, and to promote the material equality of contracting parties, is established, on the one hand, the obligation, to redact clearly and precise, in easily legible form the general contractual clauses and, on the other hand, the prohibition of including such clauses in individual contracts that cause significant imbalance to the detriment of the consumer. Its use is governed by DL 446/85 of October 25 that establishes rules regarding the inclusion in singular contracts, the interpretation and integration and the inspection of their content, and that we will analyze in this article. | eng |
