A Revolução Digital fez irromper a necessidade de repensar o Direito do Trabalho tradicional. Ora, a evidente incapacidade deste ramo do Direito em produzir respostas adequadas aos novos desafios resultantes da massificação da prestação de trabalho no âmbito de plataformas digitais, da paulatina transferência de tomada de decisões para algoritmos e outros sistemas de inteligência artificial, bem como da robotização de inúmeras tarefas complexas, conduziu à adoção de um conjunto de medidas legislativas, quer no plano nacional, quer no europeu. No entanto, e pese embora tenham sido dados os primeiros passos, tais medidas ainda se revelam, no nosso entendimento, insuficientes, no que à tutela dos interesses dos trabalhadores diz respeito. Destarte, o presente estudo visa promover uma análise reflexiva acerca das questões mais prementes desta nova conjuntura laboral com o desiderato de contribuir para o debate doutrinário acerca dos desafios que se impõem ao legislador.
ABSTRACT: The Digital Revolution has triggered the need to rethink traditional Labor Law. The obvious inability of this branch of the law to produce adequate responses to the new challenges resulting from the massification of the work on digital platforms, the gradual transfer of decision-making to algorithms and other artificial intelligence systems, as well as the robotisation of countless complex tasks, has led to the adoption of a series of legislative measures, both at national and european level. However, even though the first steps have been taken, in our opinion these measures are still insufficient to protect workers' interests. Therefore, this study aims to promote a reflective analysis of the most pressing issues of this new labour situation with the aim of contributing to the doctrinal debate on the challenges facing the legislator.
